I disputed a mortgage account that was included in BK-13 as not mine and it came back verified with a 120 day late notation, 21,000 past due and foreclosure proceedings started. ORG AMOUNT WAS 66,000 NOW 78,000 This was the correct notation 3 years ago before I refinanced with the same company. What should I do now? I have sent letters to the OC(my current mortgage company) Disputed 3 times and I get this.HELP>>>>
Could you clarify a bit? You refinanced the original loan, so the one being reported as late is paid off? Or did you include it in bankruptcy? In which case, why are you disputing it? Could you give us a little more info to work with? Thanks! Poochie
Sorry, I had a mortgage that was included in bk-13, The bk was discharged with a balance owing, I modification with the OC, they used the same acct number, The loss mitigation did a basic modification so it was rolled into a the same loan, same number, different amount. What they are reporting is all the old late info along with the new amounts. The loan is now current,all late fees paid and so on it is just reporting badly,
Ok, I am NOT an expert so other posters may have better information. Here goes: if you disputed incorrect information, and the CRAs verified it any way, you have them on a violation. YOu need to send them a letter (check the sample letter section) demanding that they remove their incorrect information immediately and report the correct loan information. You may also want to contact the OC and ask that they provide you with a letter stating that the account is current etc etc. I hope someone else is able to provide you with more specifics on how the process works, but basically it sounds like the CRA is in the process of writing you a $1000 check.
