This is GREAT! Actually if you scroll to the bottom of the page there is a hyperlink to the right of the date - if you click on the "1" it will load the actual complaing - you need Adobe Acrobat Reader - and it takes a while as it is about 45 pages or so. In short, TU pulled and provided this guy's credit file to a telephone company in response to a request the company made for information on his Sister! They tried to justify it by saying that it was a possible match for the name as they are similar. He is suing for 1375 violations of the FCRA! Although I WISH this would actually go to court, somehow I think TU will try to settle this out of court - I'll bet someone almost had a heart attack when they were served with this at TU. For my money, it looks like he has them dead to rights.
I'll take action on that. Looks to me like this guy has screwed up and, at most, will get a nuisance settlement. This complaint shows exactly what NOT to do if you want to be taken seriously by a court. This guy is claiming that the disclosure of each individual piece of information is a violation, is seeking to have criminal fines imposed and paid to him, and a bunch of other ridiculous nonsense. Plus, he probably blew the SOL. The shame of it all is that it does look like he has a beef -- not a $12 millon beef, but a beef nonetheless. But I'll bet that TU moves to dismiss on SOL grounds and that the motion is granted, or, that the offer him a pittance to go away.
