My mother's BK 7 was discharged in 1988. In 1987, a car she had was repoed, and a collection for $6500 resulted. She of course placed this in the bankruptcy. The bank with the loan was Central Fidelity, which I think is now defunct. Well, today she gets a VICIOUS phone call from someone collecting for them. They want to give her a "generous settlement" offer for $2000. She had a letter from them STATING the debt was from 1988 and is still collectable. She told them it was included in BK. They said that does not matter nor does its age, and if she doesn't pay they're going to slap it onto her credit. She wants to sue them. How can she best establish her case?
