Need a Class Action Right Now This appears to be a pattern at Amex, and what really needs to happen is that Amex should face a class action ... if anybody who is experiencing this takes it to class action attorneys, Amex is going to have some 'splainin' to do, Lucy ... in court, with hundreds of millions of dollars on the line. An Amex executive has made an extremely dangerous and unethical decision, and they're playing with fire.
Very Sneaky Just today 10/21/08. I got a response from Experian saying it was verified. I was so ticked off. The address on my credit report says AMEX PO Box 297812 Ft. Lauderdale, Fl 33329 Here's the kicker - the info is in the good standing area of my credit report and Experian says that good stuff stays on INDEFINITELY, when I called them on the phone today. I ask Experian how can this be considered good, when AMEx puts some bogus credit limit of $100 and then throw some huge dollar amount as the amount currently outstanding? Send Help - I don't understand what you mean by there was a line on your report and that's how it was corrected. According to your experience, I have one more shot at disputing it. I'm not sure what to do. I don't want to contact AMEX. They can't be trusted and I haven't spoken to them in 15 years. I want no chance of restarting the clock. What do I do. They validated something that is not correct in any sense of the word.
I know the feeling. I was angry as well. Anyway, when I say line, I mean the actual account on the report. It was first reported on Experian. I had no luck getting Experian to remove the account. Later, the account was reported to Equifax. Equifax did remove the account after my dispute. As a side effect, I believe Amex also removed the account from Experian. Experian never admitted the account was incorrect. Only after Equifax investigated and removed the account did the account disappear from my Experian report as well. This suggest the account was removed directly by Amex since Experian should not care about Equifax's action. As for a lawyer, I had gone as far as trying to find a consumer credit lawyer in Georgia, but really wasn't too gung-ho about it. However, if this is indeed a trend, then a class action may be a bit more appealing. Anyway, keep watching your reports. In particular if your using TrueCredit, pull your report each day and look at all three reports because I didnt get a notification for the Equifax derogatory report. I just happened to see it while looking through my reports. The Experian alert was on 9/8, the account didnt show up on Equifax until 9/23. Hopefully they will follow the same pattern for you. If so, then dispute the account with Equifax and hopefully that will cause Amex to remove the Experian account as well. How does Experian get away with this nonsense?
What I found after tearing up my house Well, my husband wanted to know who broke in our house. I let him know that it was me on the hunt for anything. I even had to break the lock on my college trunk from 15 years ago. I found a check to Optima (Amex) cancelled in 1992, maybe I can use this as a last activity on the account. I also found a receipt from 1990 which had an Amex account number. Unbelievably, neither acount number matches the account number on my credit report. I read somewhere that they are reporting to making up account numbers. I also have two credit reports from 2005 from Transunion and Equifax, of course not Experian who is giving me all this trouble. Neither have any American Express Account inquiries or account on my credit report. Because the account was out of statute. Will this at all help fight Experian?
Equifax removed? "Later, the account was reported to Equifax. Equifax did remove the account after my dispute. " How did you go about disputing. I don't want to make any mistakes. I'm sorry for your troubles and thank you for helping me follow what you did successfully. I hope others find this blog. I just happen to use 'debt reappears' in my search after many unsuccessful attempts. The difference too is that it seems that it is the credit collectors who reage this debt, you don't hear anything about a big name credit card company doing it. I'm investigating attorneys through NACA.

Then, with the reports confirmation number, I did an online dispute here: https: // www . ai.equifax.com / CreditInvestigation / jsp / investigation_request.jsp I don't remember what I chose as the dispute reason because none fit the bill exactly, but I believe I chose "Not my account" or something similar. I then wrote the following in the comment field and submitted the dispute. "Illegal re-aging. The date of first delinquency on this account is October 1992. The account was already on my credit file from 1992 to 1999" Good luck. Hopefully they will report to Equifax soon. My experience is disputing with Experian is a waste of time. If they end up only reporting to Experian, then a lawyer may be your best bet.
Thank you I'm a month behind you, with all this happening in October. i am going to follow your timeline and wait until it appears on my Equifax report, which shoul dbe about the 28th of this month. I've read through this whole thread, and I have on question that I don't see addressed (or maybe it was; I'm dead tired right now, working this overnight shift): Why not contact the CRAs via CMRR and say "The date of last payment on this entry was xx/xx/1993. As per the FCRA, the statute of limitation on reporting this debt expired in 2000. Please remove this entry immediately." If the CRA refuses, it might go a little way towards making a judge less sympathetic to a "bona fide mistake" claim on their part, since it calls the matter to their attention and implores them to investigate further. This looks like a special set of circumstances under which web-based disputes may not be appropriate.
I agree whole heartidly. Unfortunately when you're ticked off you want things resolved yesterday. So I used the online dispute. At this time and with what I have read. An idiot online is an idiot on paper. I recommend to anyone who is in this situation NOT to file an online dispute, do it in writing. Your chances are greater that way. (With regard to Experian) From Send_help and my experience, online with Experian just doesn't work. If you do then throw in a last activity date and see if that works.
AMEX is like a venereal disease. You will have it for life. Call them and ask them to pay in full and if they will delete the tradeline. They will. As long as they get paid.
I didn't realize this was reporting as a positive account. You need to dispute again to Experian with specificity. I do not have a current balance with Amex. This card never had a $100 credit limit, etc etc.
Is there a list of such states you could point to? I wasn't aware that the SOL clock could be reset by simply acknowledging that an account did belong to you at one time.
Just an update. I went ahead and called Amex. I first asked when was the account closed. Once they said the date, it was a done deal. They removed it from my credit report withing 3 business days. Once again experian was a waste of time. They were absolutely no help. This time I will make sure that I have a copy of my credit report and get one every single year, so this doesn't happen again.
