2 more ?'s about paid chg off suit.

    Thanks again everyone for your responses it has been a big help to me.

    Reading a link that someone sent me regarding my previous question I learned that these company's are to follow the laws of FDPCA. It appears that I am to have 30 days to send validation letters from the time I FIRST heard about this debt I am being sued for and the FIRST I heard about it was when I was served on 3/22. The attorney filed these papers with the clerks office on 3/19 and the court date for me to appear is 4/15 which is not 30 days. Have they violated the FDPCA? If so will this favor me when I appear?

    As them when they sent you notices. Then ask them to prove you received them. If you didn't sign for them, they have no proof........

    Why are they suing you for a paid debt with a zero balance anyhow?
    So what so they expect you to do send them a check for $0.oo?
    Have you sent the Val. L. CRRR?

    Not so. I read a court ruling, it may have been the Spears case,, that if sent to the address that is listed and used by the defendant/debtor, then it is reasonable to believe they received it.

    Your bank will HATE you (if they try to CASH it)...but send them a check for $0.00...
    Their BANK will know that they are IDDIOTS and tell them to get a CLUE!!!

    Or send the CASH...find enclosed the amount of
    ZERO DOLLARS and ZERO CENTS in CASH ($0.00)

    If this is so ,then can't we also reasonably believe a Ca received the Val. Letter even if we don't get the green cards back-especially when we have the mailing receipt from mailing it CRRR?

    If you have the receipt but never got the green card back, I think you could make a case that it is fair to believe they received it.
