Hi. I have an entry on my credit report showing a Citibank card that I fell behind on. Several years ago (~6 yrs) I settled this debt with a collections agency. However, recently I noticed this debt was still on my credit report AND still showing as PAST DUE!!! Unfortunately, back when I settled the debt I did not keep good (if any) paperwork so I don't have any proof that I did settle it. Also, I know this debt is close to SOL but still want to get it cleared off my report. So I sent a debt verification letter to Citibank requesting that they verify the debt and send me that verification. The letter was sent certified mail and Citibank received it approximately 6-7 weeks ago. Since it's been over 30 days what can I do to get this off of my report? Should I send a second letter to Citibank? If so what should the letter state in addition to what the first say, if anything? Can I demand that the CRA's remove the entry from my credit report since I have not heard back from the creditor? Any advice would be appreciated. Joseph
Is it Citi reporting, or is it a CA? Have you disputed thru the CRAs? If so, Citi has to respond to them, if Citi is the one reporting, otherwise they have to delete. Is it past SOL, or past 7 year reporting period?
The account name and contact information is Citi's so I assume it is them reporting the info. I have disputed through the CRA's but it comes back as valid. I can only assume it's validating as a valid debt but no validation as past due was done? It is not past SOL yet -- close (about a year away) but I want to get it off now if possible.
SOL is your state law limit for the period in which they would have to sue you. This is generally based on when your last payment was made and depends on state law, and the type of debt. 7.5 year reporting period is the FCRA defined period that a negative item can be reported on a consumer's credit report. They are generally not the same. How long ago did this originally go delinquent? How long ago did you make the payment in accordance with your CA settlement agreement? What is your state's SOL for CC debt? What information do you have to substantiate a settlement and payment to the CA? Do you have a settlement offer letter? Do you have the cancelled check, or a check register that would allow you to request a copy from your bank? Does the balance due as reported by Citi reflect the settlement with payment (it should be $0, and settled in full for less than full balance)? Des it reflect payments made, but fail to show it as settled (it would show a decrease in the original balance reflecting the payments)? Or does it show none of the payments as being applied (it would show the original balance)?
