Ok, so here is my spicy 2nd request letter. Please tell mw what you think. You guys know that I am not good at writing my own letters.... lol Anderson Fin. Network/AFNI, Inc. PO BOX 3097 Bloomington, IL 61702 March 19, 2002 Re: Account #XXXXXXXXXXX To Whom It May Concern: This letter is formal notice that you have failed to respond in a timely manner to my dispute letter of 02/11/02, deposited by registered mail with the U.S. Postal Service on that date. This is a request, once again, for validation made pursuant to the Fair Debt Collection Practices Act. Complete the attached form and follow its instructions. Please be advised that I am not requesting "verification" that you have my mailing address, I am requesting a "validation", that is, competent evidence that I have some contractual obligation to pay you. I am including a copy of a letter written by Jeffrey S. Wollman, Vice President and Controller with the FTC, concerning the issue of sending a printout to fulfill a validation request. To sum up the letter, "[m]ere itemization of what the debt collector already has does not accomplish this purpose." This means that a printout does not validate a debt so do not waste my time by sending one. Your continued reporting of this invalidated information to major credit bureaus might constitute fraud under Federal and State Law. I already have you in violation on numerous occasions with supporting documentation. If you continue to ignore my request, the next letter you will receive from me will be a copy of my lawsuit. This lawsuit will be filed against you and your client for: Violation of the Fair Credit Reporting Act Violation of the Fair Debt Collection Practices Act Defamation of Character Negligent Enablement of Identity Fraud Previously I had instructed you to take no action that could be detrimental to any of my credit reports, yet you continue to do so. Under the FDCPA, once a consumer attempts validation of an alleged debt, all collection activity must cease and desist. This includes listing any account with a credit reporting repository that is inaccurate and invalidated. My patience is wearing thin. If you do not respond to this additional validation request within 15 days from the date of this request, all references to this account better be completely removed from my credit file with all four major credit bureaus. You and ABC Cable have little time left to avoid legal action against you. Best Regards, Milkmom ==================================== So there it is. What do you guys think? Do I have my bases covered?
I had a bitch of a time getting them to remove something. I just kept disputing it thru the CRAs. After it had been paid for about a year, I finally got it disputed off all reports.
You are right Illini. They suck. This letter is a little spinoff from the ones that I have encountered on this board. Just want to make sure I give credit where credit is due.
What worked for me is to finally dispute it thru the CRAs with the reason that I paid the account thru the original creditor, not thru them.
NOPE. Slight misquote . Auther of the letter you refer to at the FTC was not Wollman. Wollman recieved the letter from the FTC.
