Guys you know the FDCPA states the consumer has 30days to dispute the debt or the CA can assume it's valid. Well how bout if you decide to validate later... like months later becuase you found this negative entry on your credit report and the CRA verified it. We are still entitled to validate with the CA and they must follow through as if it was the "original" 30 day period the FDCPA refers to ? The reason I ask is I'm about to quote the law in this dipute letter but it have that 30 day cluase in it where it states 30 days from originally being contacted from the CA. Not sure if that hurts my cause or not. Thanks -confused child
you can request validation at any time from the ca. even after the thirty days. If you request it in the intital thirty day period, they cannot report it on you credit report, until they provide the validation. If you request it after thirty days, they cannot continue collection activity until they validate the account, this includes reporting to the cra's.
