30 days DV and no response...what next?

    I posted about this situation a month ago. I had an auto that I let go back to the bank, I believe it was in September of 2005. I got a letter from an attorney attempting to collect payment in the amount of over $15,000. There is no way I could pay it so I requested validation. Today is day 31 and no response from the attorney. I would have thought if they were going to DV, they would have jumped on it by now. Is my next step to send a 2nd letter requesting DV? Also, in the event this goes to court is this a plus for me if they don't DV?

    They aren't required to validate within 30 days. They are only required to cease collection activity until they do validate.

    Exactly right. I would let it go and hope they don't validate it.

    Yes, if they sue without validating first then you would have a marginal counter.
