Okay, I was reading in another post, and one of the posters there said that you have to allow the credit bureau a certain amount of days in which to receive the dispute, and then allow ANOTHER 5 days for them to send it back to you. So is the dispute time 40 days instead of 30? Ive always read (and been told) that its 30 days, with no fluff included. That is the time they are allotted by law and the time in which they are to settle ANY and all disputes. Someone let me know whats up? Otherwise, Im excited over nothing......
OK.. assuming you sent the Validation letters CRRR, the starting date should start when the green card has been signed... 30 days should be 30 calender days... I am still looking up via search on the tail end of the 30 days....
Now maybe you'll believe me when I say something. I don't say it for the hell of it. § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (a) Reinvestigations of disputed information. (1) Reinvestigation required. (A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer.
What about online disputes? For the most part, my friends (as well as myself) have disputed online, after which you receive a confirmation (at least with TransUnion) that the dispute was received and also stating that they will respond within 30 days. LKH, when I asked the question, it wasnt to try and say YOU were talking 'just for the hell of it;' It was to find out if others had heard anything about having 4 or 5 extra days of fluff! Like I said, I know people who have disputed (online and otherwise) and if they started their dispute on the 1st of the month, they gave the credit bureau until the 31st (or the 1st, depending on what month it is..in example) to get back to them. Otherwise, they served them a follow up letter.
And as far as the 5 days to notify you. If, the cra receives verification on day 30 of the dispute, then they still have 5 more days to notify you. § 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i] (6) Notice of results of reinvestigation. (A) In general. A consumer reporting agency shall provide written notice to a consumer of the results of a reinvestigation under this subsection not later than 5 business days after the completion of the reinvestigation, by mail or, if authorized by the consumer for that purpose, by other means available to the agency. (B) Contents. As part of, or in addition to, the notice under subparagraph (A), a consumer reporting agency shall provide to a consumer in writing before the expiration of the 5-day period referred to in subparagraph (A) (i) a statement that the reinvestigation is completed; (ii) a consumer report that is based upon the consumer's file as that file is revised as a result of the reinvestigation; (iii) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available; (iv) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the information; and (v) a notice that the consumer has the right to request under subsection (d) that the consumer reporting agency furnish
Maybe it was the tone, something about it rubbed me the wrong way. Forget it. If a dispute is completed prior to the 30th day, then you will be notified prior to the 30th day.. The law says they have 5 days from the completion of the investigation to notify you. It doesn't differentiate between online, phone or mail disputes. So, in reality, it can take 5 days for mail, 30 days for dispute, and then 5 more days for your notification. A total of 40 days. If you did your dispute online and the 30th day has passed, I would wait til the 35th day and if you haven't received anything by then, then I would blast them.
