I received first letter from ENCORE.Do I need to send validation letter within the 30 days or should I just let it go for now?Do I lose my right to validate with them later if I don't do it now or will I just be waking them up?My 30 days expire this week so I need help fast!Thanx!
If you request validation from a CA they must cease collection efforts until they provide proof of the debt. This can be done at any time. If you request validation during the initial 30 day period, the CA cannot assume anything about the validity of the debt, and must provide you with proof before they pursue collection efforts. After 30 days has passed the CA can assume the debt is valid since you did not challenge it, and can pursue collection efforts.
