ANOMALY847, HOW DO CREDITORS GET BOTH, IF I GOT APPROVED WITH 1 CR. HOW DO YOU EXPLAIN THE CAR LOAN CR THAT THEY PULLED IN FROM OF ME, I SAW IT. PLEASE EXPLAIN THIS.

Hopefully, it IS NOT a split file issue. I don't think your phone call had anything to do with it - they hear those threats everyday.

It was either a HUGE mistake on their part (deleting everything) or the file somehow got split. The split-file issue is not unheard of - there are a few on this board who experienced this type of situation.

Personally, I would take advantage of it and get some prime credit while you can. Even if they did delete everything, unless they cloaked it, the negs will probably re-appear once the creditors update their reporting.

That's because those two creditors (Sears and the auto finance company) received a single Equifax file with a terrific score. However keep in mind that if you have collection agencies coming after you, or if you are actually late with some of your other current creditors, that you'll begin seeing negative entries on your report again just as soon as the next reporting cycle completes.

    Doc

P.S. I had a split file with Trans Union for awhile. It's a very strange freak occurrence, but it does happen. Your experience with your two most recent credit applications suggests that perhaps this isn't the case, though.

What's going to happen is that you'll see these tradelines reappear.

At that point, you might contend that you weren't informed in advance of the reappearances. (And, of course, you won't be.) The FCRA requires that you be informed at least 5 days in advance whenever a previously-deleted tradeline reappears. If you're really creative, you might then confront Equifax with the fact that they have broken the law multiple times by not informing you in advance about the reinsertions. Whatever happens, keep us posted here as it develops. I'm sure you'll get some great advice no matter how it turns out.

Why is everyone saying Bkev is outta line? Actually, I don't see where he said anything that was anywhere near outta line on this one.

Remember, the original post DID say that Equifax told him the file was TOO BIG (red flag for splitting) to start off with. Danstarr, disagreeing with you doesn't mean someone is outta line.

    Doc....

You are partially correct. They are only required to notify you in writing if the account was originally deleted as a result of a dispute. Unless he can prove the accounts were disputed, Equifax does not have to notify him of anything.

I AM NOT REALLY SURE WHAT TO THINK. IT IS JUST VERY CONFUSING FOR ME. I AM SHOCKED THAT THIS HAS HAPPEND. BUT IT JUST DOES'NT SEEM LIKE IT IS A SPLIT CASE. WHERE IS THE OTHER FILE FOR THE CREDITORS. THE ONLY PEOPLE THAT TOLD ME ABOUT THE FILE BEING TOO BIG IS EQ TECH SUPPORT. THEY SAID THAT SINCE I AM NOT ABLE TO GET MY CR, IT PROBBALY MEANS THAT MY CR IS TOO BIG.

I HAVE CREDIT REPORTS STATING THAT ALL MY NEGATIVES WERE IN DISPUTE MULTIPILE TIMES. I GUESS I SHOULD KEEP THE CR THAT THEY SENT ME, HUH? HOW WOULD I PROVE THAT THEY DID NOT NOTIFY ME WITHIN 5 DAYS?

THANKS TO ALL WHO ARE HELPING.

Tmitchell, I think you're right about that. Otherwise, a CRA would be in violation if, for example, a creditor UDF'd a tradeline on its own accord one month and then decided to reinsert a few months later. Obviously in that case the CRA would have done nothing wrong. Good catch on that. On the other hand, I'm not convinced the CRA personnel handling the complaint would necessarily realize that the items were never disputed in the first place even if they weren't. (In any case, it sounds like the items were in fact in dispute in Dan's case. I think it was a series of disputes that resulted in the original disagreement Dan referenced.)

Ok, now it's my turn to point out where you're partially correct. :) You said everybody said Bkev was out of line. Actually only Charlie and Dan said that. I don't think he was out of line either.

    Doc...

As I wrote "everyone", I had a feeling someone was gonna call me on the carpet on it. Yes, you are correct - it wasn't everyone - my bad:)

As much as I hate to say it, I don't think bkev was out of line either. All he did was give his thought on what was going on.

You are right he is not outta line...just jumping to conclusions. Danstarr has had his/her credit pulled since and the creditors are not seeing information that Danstarr is NOT seeing. You are correct it can happen (and too big file may be a trigger for such an event) but I would not assume that to be the case.

Like I said, if I asked for my report and saw "X" and applied for credit and my creditor saw "Y", I would sue sue-sue-di-o. In a NY minute. But this time I would apply for a hefty mortgage with a lender that will agree to share the report and reasons with me if I get denied...get denied....and I would skip small claims court if you know what I mean.

Bottom line...don't suspect it until you see it...BKev is looking in the shadows for anomalies and acting like they are the norm.

Anyway I guess we shall see. Keep us informed Danstarr.

    -Peace, Dave

I'd be interested in hearing from some of those who have had split files.
