5-day Notification of Re-Insertion

    I noticed TU had a 90-day late added back into a previously disputed (and corrected) account.

    Do I have to have something in my "hand" within 5 days or does TU have 5 days to send something out?

    I'm having difficulties interpretting this section of the FCRA...

    ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.

    I believe it means the CRA has 5 business days to send the notice out.

    So, if you pull your report and see it re-inserted on 4/1/02 (monday), they have until 4/8/02 (monday) to send out the notification. It would have to be post marked by 4/8.

    Of course if you're someone who does not check their reports every day, it could have been re-inserted days even weeks before you checked it and found it re-inserted.
