60+ day response from Experian

    I began disputing a TL placed by American Agencies on my CR's way back in the first week in August. Experian had not responded as of Oct. 7, so I sent them a letter (+ a copy of the first letter) saying that their 30 days had expired. Just got their response yesterday. Instead of removing the TL, they merely reinvestigated and it came back verified. What's my next best move?

    I guess I'm going to rant about Experian here...

    Of the three, they are the ones that seem the most incompetent. They also don't seem to give a crap about their obligations under the FCRA. If you watch them carefully, you'll have plenty of reasons to sue.

    I've sent them letters of dispute that they have totally ignored. A violation of 611 (a) (1) of the FCRA.

    I've sent them letters of dispute and they've responded with 'was previously investigated.' This is a violation of 611 (a) (1) unless they follow 611 (a) (3), which they didn't.

    It takes them days longer to get disputes into the system, than it does EQ and TU. I've had things easily deleted off EQ and TU that EXP verifies everytime. I really wonder whether they do any verification.

    I've asked them for the process used to verify on two different occasions and heard nothing from them. A violaton of 611 (a) (6) (B) (iii) and 611 (a) (7).

    I'm about to file suit in another few days.

    All I can say about EXP, is save a copy of every thing they send you and everything you send them. To get anywhere with them, you will have to go to court.

    Atlanta, I can certainly appreciate your rant concerning CRA's. EQ has been the most cooperative in my circumstances, but TU and EX just suck. I've kept a detailed "calendar of events" concerning repairing my credit, and have copies of all correspondance. That was the first thing that everyone told me to be sure to do. :)

    I'd still like to know what I should do about EX verifying on a TL dispute that had run more than 60 days. Should I write a letter to EX, and just what should I say?

    You could write them a letter saying you had documented a clear violation of the FCRA on their part and ask them to delete it immediately or risk suit.
