I have a negative account that falls off in May of 2005..some 7 months away. Well, recently I have noticed that they have also handed it over to a collection agency that has added themselves to my credit report but have NOT attempted any collection effort whatsoever. Will they aslo fall off in May ?? I seem to doubt this without a fight. How do I present this issue to the credit bureau that they also should be deleted. Otherwise this account stays alive for another 7 years with zero collection effort. Only an effort in buring my credit for 7 more years. How do I handle this ?? I want to be proactive on this. thanks
The date it falls off is measured from the original date of delinquency, when a payment was due and not made. This should have been reported to the CRA by the OC, and when the CA also placed a TL on the report, they should also have reported the same date. They are required to report this date to the CRA within 90 days of reporting the TL. Sending an account to a CA, or selling it to a CA, does not legally change the original date of delinquency, and therefore does not legally change the date the account should fall off your report, regardless of how many times the account is moved around.
I just recenlty had a collection pop up on an account I filed in my BK7. I disputed the orignal tradeling and the collection at the same time as duplicated and they both were removed.
