I have a CA trying to collect a debt and they keep racking up the violations. I sent them a validation letter and on the same day they recieved it they called me. Then again today before I recieved their answer they called me again, vioaltion #2. The debt was anly $1700 and they have already commited $2000 worth of violations. Maybe I can get them to give me money. AJ
In most states it is a maximum of $1,000 per action (not per violation)unless it is for Permissable Purpose. Some states, such as Cal. are tougher. Sounds like it might be worth it for them to drop the collection though.
The 9th circuit court ruled that the $1000 per violation no longer applies last spring. And if the plaintiff claims mental anguish, pain and suffering and all of that stuff the damanges can be unlimited. It was that way long before the 9th circuit ruling too.
Is there a link to the 9th circuit case? Does it only apply to FDCPA violations? Was there ever a "per action" limitation for FCRA or does each violation there count seperately? 0
