What can I do about a judgment where I was never served? I pulled my credit and saw one for over 4k and I can't tell who the original creditor was. I know I don't owe anything like that to anyone unless it was really old and past the statute of limitations. Should I write the court contesting it or what? I am disputing it with the Experian but I don't know how to take care if this situation past that.
Call the Court Clerk's office because they'll provide the information on the process and procedure. Depending on where you live, and the terms of service, you may want to investigate if the law requires personal service of a summons. If a process server swore that they served personally served you, when they did not, that's perjury and judges take a dim view of that in their court. Get the file and see what's in it.
Call the Court Clerk in AZ to obtain the file. Every court has different rules but you should be able to obtain everything in the file. You need to see the paper trail that's in the file which led to the judgment.
I have one last reported in early 2001 and one last reported in early 2002. They are both for less than $600. I am afraid if I contact them that I will get harrassed and I want to pay them but I do not have the $$ right now. What can I do? Thanks in advance.
Just so the two of you know, the clerk you talk to will not give rat's ass about your file, they are there to provide the information to you. I had a judgment about a year ago and it was a bogus one so I had no fear in calling them and I swear I was going to have to bang my phone on the desk to wake the person up.
