a little off topic.

    I know this is off topic but I thought since you guys around here are so smart someone might be able to help me with this. We are trying to purchase a home through someone without a realtor. We have a signed purchse agreement and he took our earnest money. His house didn't appraise for what he wanted. We have been trying to contact him all week and he won't return our calls. He still has our earnest money check. Well today when I drive by the house, it has been listed with a realtor!!! How can he list it when I have a singed purchase agreeent from him and he still has my check??

    the house can be listed until the final docs are signed just in case it falls through.

    i would contact the realtor and cancel the check.

    How can he do that when he wasn't dealing with a realtor ?

    let me rephrase...

    cancel the check and run away from the house!

    if you must pursue it cancel the check to the customer, contact the realtor and resissue the check to the realtor.
