Can someone explain the difference? I would also like to know if you have your BK dismissed... Do you have to wait for it to fall off of you CR? If so how long does a Chap. 13 remain? I know I sounds dumb but I have NO clue how BK works!
Also.. if you where making payments then you got laid off and stopped making your payments and never made another payment. Does the SOL kick in on what you should of paid? or how does this work?
A discharged bk is one where the court has held the hearings and decided to grant the bk, and/or in the case of a chapter 13, the debtor has completed the payback period and now the case is discharged. A dismissed case is where it is either thrown out/not allowed to proceed for some reason, or, the debtor can withdraw the case, then it will be dismissed.Did I make any real sense? lol
Yes.. you made sense...lol What do you do if you have a BK that was dismissed in 1996. Do you have to wait for it to fall off? Or is there some other tactic you need to get this off of one's CR?
If it was a chapter 13, it will come off on it own next year. Look for any mistake in the listing of it and dispute it as incorrect - please delete.
What I don't understand is... if it wad dismissed that why would it be on your CR? I'm confused...help...!!!
According to the cra's, if it was filed, it was a case, and that gives them the right to report it. I would just dispute it. Experian and Equifax gave me no trouble at all. TU I had to go around and around with them til they finally removed it.
The dismissed/discharged does not change the fact that one filed a bk-13. I filed a bk-13 in 1996 and was discharged in 2000. EQ and EX has it reported that I was discharged, while TU has me listed as dismissed. I have disputed this twice and twice TU has come back as being verfied. Hope this answers your question. I was under the impression that if you filed a BK (CH 7 or CH 13), it lasted 10 years unless you filed and completed a CH 13. But I may have been reading propaganda, does anyone know fore sure?
