I am not sure what you are saying. In anycase, if the account is showing on your credit report listed by a collection agency you would deal with them by sending them a validation letter CRRR. Once you receive your green card back you can begin checking your reports to see if it is listed as "in dispute" if not this is a violation. You need to keep careful records of everything just in case you need to go to court. You can also dispute with the CRA's during the validation period. If they verify before providing you with validation, this is another violation. Again keep careful records of everything this is your leverage for an eventual deletion.
Interesting...so when the CA gets your certified letter to validate, they have to contact the CRA and put it in dispute? How many days do they have to do that from the time they sign the green card?
What I'm saying is, I have a collection that I never received any notice on. The first time I realized I owed something was when I pulled a report. I'm asking, if I am not properly notified of a debt, can it remain on my report if I make an honest effort to pay? (I just looked this over and it sounds a bit rude but it is not intended to be) -0m
it does not matter if you know about it or not. if the CA wants to keep it on they keep it on. You should read alot of stuff here and start the process else you will be burned. I spent 3 months and over 100 hours before I started. I made sure I knew every angle and trick in the book and had every case law down pat. my bookmarks have about 30 links of laws and statutes. Since then every Ca and CRA has caved in to my demands. They all tuck tail and run. I even had one CA say they were closing and deleting the account because they wanted no part of me. Learn, listen, and then strike with no mercy.
The answer is yes. In fact it will stay on your report for 7 Years paid or not paid unless you get a signed agreement to delete prior to paying!! LB 59
Thanks LB59. I know some time back a friend was charged w/driving without a license and it was thrown out of court because he never received notice of the suspension. I didn't know if some of these rules applied to credit laws as well. Thanks again, -0m
