I happen to be in one of the states (Illinois) that requires 2 person consent to record phone calls. I sent off a valididation letter to RMA. I didn't send CMRRR (I know I know...I'm working it out now.) I know they got it because they called and asked about the letter. I can't prove anything though. But in our heated conversation, I asked if I had permission to record the rest of our call and we would discuss the letter. The rep told me that they were already recording all calls for quality assurance. I was never notified at the beginning of our call that I would be recorded!! I have had maybe half a dozen phone calls from them this week. My question is, even when you do send CMRRR and they do continue to call, how can you prove they keep calling unless you record phone calls? I have been keeping very strict notes on our conversations? They do not identify themselves as a collection agency and I never can get a rep's name directly. The debt is about 2 years old and for what they are saying is $1800 from Providian. I think I have racked up that much alone in validations, but like I said before. How can you prove phone calls happened if you can't record them?
Did you say in the letter "DON'T CALL ME" ??? RESPOND BY US MAIL ONLY!!! You can record any phone call then TRANSCRIBE it (like in HIGH SCHOOL or COLLEGE)...JUST DON'T EVER PRODUCE IT IN COURT...you just took good notes. 2:41 PM on 03/27/2003 I received a call from XXXX company said her name was MRS JONES...she had an ATTITUDE from the get go...she was asking about the letter I sent......
