Academy company for Capital ONE

    I have a disputed account with Capital One Credit card. I sent a letter explaning that I have been victim of Identity thef, sent them the name of the police department investigator handling and phone number and case number.
    This was two weeks ago.
    Today I have two notes from neighbors saying "A collection agency contacted us in effort to get you to call them at this number" They also were told that I had two accouns with capital one that were in collections. I am in California.
    I filed a complaint on the FTC web site but I have my doubts that will be read any time soon.
    What to do next?
    Please let me know.

    What do you do next? How about suing the Collection Agency for violation of FDCPA? They had no right to tell your neighbors that (a) they are a collection agency and (b) they are trying to collect for Cap1. BOTH of these are FDCPA violations. File suit and collect your $1000 damages.

    I have sent them a second validation request letter with a second page demanding immediate removal of the data, apology letters to those affected, in the next 30 days or be sued.
    I have contacted an attorney who will take the case, sent in a complaint form to the FTC and California Attorney General's office. Both the FTC and Attorney general public inquiry unit will not represent my case but will take the information for their own purposes.
    I think that if they satisfy the demands including the formal letter of apology, and the removal of the incorrect data I will be satisfied. I have been advised by attorney that their letter of apology would be an admission of wrongdoing and expose them to even more legal action.
    So it looks like you are right and I will be engaged in a law suit. This just goes to show how some poorly run company (collection agency), can invade even the innocent people's life, and neighbor's lives.
    I would also guess that I need to find some resource for California to challenge Academy collection agency's license, being that incident has violated several laws willfully. To tell neighbors that they are a collection agency for two Capital One Credit cards, hurts my reputation and makes my family look bad to the small community.
    If anybody else has any experience in this matter of who else to nofity please let me know.
