Woke up this morning and noticed my checking account was empty and I could not withdraw from my savings account at the ATM across the street. So I talked to my bank and my accounts are frozen and I was given a name and phone number to call Monday morning. I also was able to find out the amount that my account is being blocked for which is twice the funds I had in my account. I had two CC's in college that I neglected to pay, looking at my CR I see judgements have been made. The two CC's were with the same bank so it is unclear to me if the amounts were combined or if a judgement of TWICE the amount of the levy was made against my account (NY State). Do I call the CA directly on Monday to find out their terms, or do I seek professional help and if so what type of help should I seek? The bank officer when I visited a branch in person said my funds were still in my account they are merely frozen and that I need to come to payment terms with the CA and then they can unfreeze the account (not sure how common that is). Otherwise he said if we do not reach an agreement then the CA needs to negotiate (?) with Citibank's legal team to seize the funds.
Not sure if it matters, but the CA is Pressler & Pressler - aka New Century Financial I found this link: http://www.geocities.com/presslerclub/
I don't want ya to get into any more trouble (and hopefully someone else can chime in), but my first instinct was to say, if ya could find a lawyer in your area that deals with stuff like this, I'd run and call him Monday ASAP.....Or today if he's open... Is it possible to contact Citibank and see what's up? I'd much rather deal with/try to deal with the card company itself, than a CA....even though they got the account, and there's a judgment there. Oh, and make sure if Citibank, or anyone else promises you something, ya get EVERYTHING in writing!, cause I don't want them to screw around with you like the CA did with yer money.
Ok this is the DV I will be using, now I am guessing I have to WAIT 30 days before my funds are unfrozen? Ugh, this is going to be a tough 2 weeks I read I should open a new bank account under a different primary (of someone I trust) and then add myself as a signatory, does this sound right?
I know ya know that if ya open up an account with someone, make sure you trust the person well I'm wonderin too, if ya put money somewhere else, will some snakey CA lawyer find it anyway. I can't answer the rest of your post right, but before you do anything - see what a local or other attorney says, cause he might see something that you mighta missed, or he might can get the CA for going into your account. I know some of them will seize or freeze accounts...but an attorney might find an angle that they missed, and get it unfrozen. And, once ya do talk to someone, they might tell you that you should have sent letter ABC, etc...... I wish ya luck!
