Ack! CA verified...now what?

    Hiya creditnet folks,

    The following came back as "verified" by the Collection Agency (and quickly) which included a copy of the bill from the original creditor:

    Collection Service Center
    Balance Owed: $74
    Date Opened: 9/1999
    Reported Since: 10/2001
    Last Reported: 10/2001
    History: Collection Account
    *I paid this account to the original creditor

    Anyone have any advice on how I should proceed now? I haven't disputed this one yet with the CRA's. Should I threaten to sue (nutcase?) at this point with the CA and dispute with the CRA's?

    I'm very disapointed in this as it was my first response from a validation attempt (I just started). I had hoped for better results. :(

    I also wanted to note that the copy of the bill came back with the following statement:

    Per your request, copy of the OC's bill. If you need a copy of your signature, will need to contact the OC due to the new law.

    They then list a contact name and a phone number of the OC.

    What is this "new law" they speak of? Is there anything I can use to my advantage here?

    Hiya jlynn,

    Yes, it was for a trip to the emergency room that I had assumed my benefits covered (at the time). I paid the OC when I first caught wind that they had sent this to a CA. The OC hasn't reported anything on my credit reports, only the CA.

    The new law they are referring to are the changes to HIPPA. Plan ahead your next visit to pick up prescriptions...geez took us 20 minutes and umpteen sigs at Eckerds.

    Anyway, I'm not super familiar with it, medical hasn't been a problem for me yet....

    DD broke her finger and has to go to a sports med dr because she's a pitcher (10yrs old for criminy's sake!), and DS severely sprained his ankle 3 days later--bills are starting to pour in.

    Anyway, do a search on HIPPA, and find a post by Whychat. He has a link to his website which is full of excellent info on it.

    Did I see right, that you paid this already to the hospital? If so, I would send a copy of cancelled check with letter demanding they delete immediately. There is probably a sample letter on this site.

    Unfortunately I had paid it years ago and don't have a cancelled check. I'd have to go to my bank ans see if they had a record of this. That might be rough though. It's probably been 3 years since I paid it.

    This debt all got started when I assumed (wrongfully) that my trip to the hospital was covered by my benefits. They covered most of it, but there was some left over to pay. I always get something in the mail that details my benefit usage when I make an office visit to the Dr., hospital, etc. They always come as "THIS IS NOT A BILL". Being that I didn't look at this one carefully, I let it go and here it was a bill. Then I had this collection agency start sending me stuff on it so I paid the Hospital directly (if I knew then what I knew now about my credit I would have handled it differently).

    I've read through this before but I'm kind of taking it all in and learning as I go. Thank God for you folks here on creditnet. I never even had the nerve to take the first step before I came here. I'll give the that post you linked to another look over. Are there any specific references on it I should look out for that apply to my case here?

    I guess I'm still fuzzy on some of the legalize on validation, which is why I requested additional help. :)


    I guess I had hoped for deletion but I know I shouldn't expect that right from the get-go. I'm just being impatient is all. Any time I get discouraged I just come here and do some reading...always helps. :)


    Thats great news! Do you have any advice on how I should follow up on this? Any sample letters out there I could reference? I want to make sure I can proceed with a strong follow-up.

    This is all the more reason to make the CA do a total complete & accurate Validation which Includes a complete accurate account history showing all charges and credits on the account.
    If ever I saw a case where proper validation was critical this is it.

    mcdavis4 I wouldn't.
    What I would do is Let them screw up a few more times and sue them for a few thousand.

    These leaches politely termed CAs need to be taught a lesson that it don't pay to screw the consumer.

    The consumer can still peruse legal action against CA violations even it the CA deletes the listing or returns the debt to the OC.

    1*Validation Consist of the following
    A*A copy of the contract with your signature
    B*A complete account history showing all charges and credits.
    If what they send you lacks either A or B they have not validated. This all has to come from the OC to the CA who in turn has to forward it to you.
    What you received from the CA did not contain either item A or B so the CA did not validate.
    They try to throw you a curve with letters like the one you received to confuse you and get you off track.
    2*Here is how you stay on course:
    Ignore such letters and statements like they sent and proceed as if you never heard from them.
    30 days after they sign the green card send the estoppel letter.
    15 days after they sign the green card for the estoppel send them an intent to sue letter (I T S) if they still haven't properly validated.
    It's all really pretty simple as long as you don't fall for their trickery!

    I've been studying that link you mentioned above on validation and that helped allot. I'm still a little fuzzy here but I'm definitely more clear on it.

    I do have several questions though:

    1) Should I sit on the response they mailed to me and follow it up at the end of 30 days with a "you did not validate properly...remove it"?

    2) Should I fire off another letter requesting that they "properly" validate this time?

    I now see that what they sent me was NOT proper validation. I'm unsure on what step to take next however.

    What should I go from here?
