A charged off Bank of America CC account has just appeare on my TU report. Updated 7/1 by Red Rock Capital out of Massachusetts. How should I proceed? Do I have to go the whole validation route with this CA? Dispute through Trans Union? File a lawsuit?? PS - Last payment was made in 1993, no activity since.
If the date on the report shows a date of last activity of 1993, then it should be easy to remove since accounts should only show for 7 yrs. from the DOLA.
I just called the jackasses. Before I came unglued, the idiot claims a DLA of 1998. Impossible. I haven't done anything on this account since 1993, which would have been the last payment. Man, just when I was getting things cleaned up along comes the oldest of accounts to haunt me.
What state do you live in? Also, I would ask for validation of the debts including proof they are yours and I would ask for all last statements including proof of the DOLA. Then I would sue em till their ears bleed.
I am in California, the SOL was up a loooong time ago. I just re-read the TU report, says account opened 6/1/02, reported 7/1/02. I am so stinking mad right now. I can't believe I have to go down the validation road again! I am so sick of writing letters and being ignored etc. GRRRR!
Heck I say screw the validation. Just send them an intent to sue letter but make sure you list the statutes of all their violations. Or you could do the validation and watch them stupidly rack up even more violations. It may take a couple months but just think of al the fun you can have as long as you do not need any credit until then. Fax them the validation letter and the day after you send it dispute with all 3 CRAs. This way when they verify during the validation process you can get another 3k. Just dispute with the CRAs as 'reaged account from 1993. Illegal reporting.' I am gaving a ball with a CA that is trying to collect a SOL debt and the best feeling is knowing they cannot touch you.
You're right picantel, thats a better attitude. I've never used the intent to sue but this sure as hell feels like the right situation. Do you really think I should be so specific in the CRA dispute? I've always used "not mine" and that worked. Do you see any drawbacks to giving them exact reasons for the dispute??
