Hi everyone, This is the response I recieved from a collection agency when I requested a "real validation" Dear sir: This letter is in response to the correspondence we received from you dated 1/13/2002...bla bla bla The fair debt collection practices act does not require a noterized statement by a person with original knowledge of the debt...bla bla bla ACS, inc is in no way, by our actions or otherwise, waiving any claims or agreeing to pay any costs or attorneys fees. ACS as a contracted agency does not report account information to any credit bureaus. A COPY OF THE ORIGINAL PROMISARY NOTE AND STATEMENT OF ACCOIUNT HAS BEEN ORDERED AND WILL BE MAILED TO YOU. (Am I the only one here that thinks this is a crock of #*^%&^$#)?????????? -Sal
No. It sounds like they can't validate...they're stalling. Give them their 30 days to validate...no more than that. As of now, they aren't validating...they're trying to get proof. Calmest_LA
When did they receive your letter? I think they know they're screwed and are just trying to bluff you. Also, I wouldn't expect to see the documentation they promised to ever arrive...
sal,can you post the validation letter so that I can use it? I have a providian account that acs is handeling and want to send them a validation letter. thanks
Andrew, They actually received my letter on 01/17/2002 - I just got the reply yesterday. Isn't it hillarious how the answered my validation..lol All they sent me was a list of balances - but not one shred of proof of which I demanded. Additionally, they did not fill out my disclosure which I sent them with the letter. -Sal
Leo, I used the debt validation letter #1 in the "sample letters" section of this board. Good luck, and really mess with they're heads, Sal
