Adverse info reappearing -TU Trys

    Good news I found from:
    (Cousin v. Trans Union Corp., 5th Cir., No. 99-60429, 3/21/01).

    Terry Cousin apparently has a flawless credit history, except for reports relating to the fraudulent conduct of others.

    In 1984 and again in 1993, Cousin's brother, Richie, misappropriated Cousin's name, social security number, and other identifying information in connection with automobile loans. The loans obtained in 1984 became delinquent and were listed negatively on Cousin's file with Trans Union. In 1993, Richie's downpayment check bounced, and the dealer contacted Cousin, who explained that his brother was an imposter. A negative comment was nevertheless
    forwarded to Trans Union by the lender, General Motors Acceptance Corp. (GMAC).

    There were many attempts to correct the report, but the adverse incorrect information kept reappearing in Cousin's file, even though Trans Union used a cloaking procedure intended to prevent deleted information from reappearing in a file...

    Since deleted information can reappear in a consumer's file if the credit grantor again reports it, Trans Union has devised a cloaking procedure to avert such errors. Trans Union attaches a cloaking flag to a file with deleted information. The flag remains with the file until the credit grantor has deleted the inaccurate information for 12 consecutive months. At that point, Trans Union believes that the grantor has permanently deleted the information, and the cloaking flag expires automatically.


    I wonder if EQ and EX have something in place like this. I doubt it because I have had things come back on Experian, one that I am filing a suit over right now. I have not had anything come back on my TU report.

    Hey, at least you can get your TU report. I'm still trying to get them to send it.
