    I asked Kristi about my question recently. I wanted to know just how and what the creditors give to the CRA to verify a dispute. Kristi advised me that I can request what information the creditor supplied myself from the CRA and if they can not give me this information then it must be removed!

    Hi mom!
    Here is the rule exactly.

    (2) Prompt notice of dispute to furnisher of information.
    Section 611 of the FCRA:
    (A) In general. Before the expiration of the 5-business-day period beginning on the date on which a consumer reporting agency receives notice of a dispute from any consumer in accordance with paragraph (1), the agency shall provide notification of the dispute to any person who provided any item of information in dispute, at the address and in the manner established with the person. The notice shall include all relevant information regarding the dispute that the agency has received from the consumer.

    I've requested this from Experian. You know what they told me? We called 1-800-Discover. Thats all they gave. Any suggestions?

    Tell the idiot you spoke to that they obviously have not read the FCRA! It is THEIR responsibility to provide YOU with the proof. Threaten to contact the FTC or DA!

    I hope Experian reads these boards daily, their actions are a joke. They have to give you that information and it must be reasonable research not "we called discover".
    Go to WWW.FTC.gov & file a complaint about non-compliance to the FCRA.
    Ps:Experian if you are lurking (which we know you do) We have already been told by several of our partners that Experian has had meetings about Carreon & Associates because you quote "Think we are causing you too much work" End quote from partner.
    If you were FAIR & REASONABLE we would not have to help in the war on inaccuracies now would we!

    Kristy, surely you realise that "any" time not spent on their subscribers is considered too much work.

    I can easily picture the reps quoting their "verification" source from a readily available list of a companies' last listed telephone number. Of course this invariably brings up cases were a company has changed phone numbers unbeknowest to the do-nothing reps, merged or even gone out of business!

    Naturally, when informed they that have been caught "red-handed" in a lie they immediately proceed to delete the account in question in an attempt to eliminate the evidence.

    Now while all 3 CRA's are consistantly guilty of this action, the fact that Experian stands out with the amount of complaints received (you must acknowledge the fact that usually only a tiny minority ever complain) belabors the question just what percent of the verfications are FAKED.

    It would be most enlightening to find out and assuredly would cause a national scandal.

    I thought that was pretty ridiculous too. I mean, I waited all that time and they gave me a phone num ber that I could have found myself? Anyway, I KNOW that they didn't call 1-800-DISCOVER, because Discover card told me. And I got Discover card to agree to remove the information, which they did, no problem. They even apologized.

    Anyway, if you read my earlier posts, Experian LOST my last dispute letter (I say LAST dispute letter because since they faked the investigation the first time, I had to dispute again) and I am supposedly going to get a call from them today with an explanation of what happened. Well, it is now almost 7:00 pm here, no call yet...I hate them.

    Equifax does the same thing. They pulled the same crap with me. Allegedly verified an account that I was disputing. It had been sold to MBNA, but both account were listed on my report as 'Open'. The provided a toll-free number as the point of contact, and it was disconnected. When I wrote them another letter pointing this out, they changed the account to "Included in Bankruptcy", probably as punishment for taking up their time with such 'petty' disputes. I was not amused. Then they got a letter from my attorney. It was fixed within days. I got a new, correct report.

    Well I gotta admit J. Edgar you get "all the luck" considering TransUnion pulled the same 'scam' on you http://board.creditnet.com/read.php3?num=1&id=5800&thread=5761
    though at least they didn't try to screw you like Equifax did. I take it this was for the same account? If so, two CRA's faking verification on the same account is a most damning indicament.

    If not, guess it'll be Experian's turn to screw you over next. I know you are just shivering with anticipation :):)

    It's ridiculous how bad Experian seems to be getting. The disputes continue to pour in and they continue to "Verfiy as accurate". It is just a matter of time until another large settlement. What Irks me however, is the shadyness of it all. I wrote to them regarding the constant perusing of our site and rather then reply directly to me, they contacted our affiliates? This round about way of hiding and cloaking has got to stop.

    Even the other reps I spoke with at the other bureau said they had no comment on Experian but had heard so many complaints. I have told them several times, if they accurately reflect the accounts for consumers then they have nothing to fear from our website. I did also just recently get a call from a radio station in Calif that wants me to come on and speak of the nightmares of innaccurate credit reporting. I am sure if I do, I will be followed home by the men in black (LOL).

    Well, the opportunities for CRA and creditor shennanigans with me are about over, because as of today, I have NO outstanding debt to anyone. Paid them all off with money from a bonus from my former employer. I've closed a number of credit card accounts over the past couple of months. You've heard about my adventures with trying to close my FirstUSA accounts. I am going to order my reports in about two months to make sure that all of the dust has settled correctly.

    Next step is to fluff my FICO score up as high as I can before I go after a mortgage. If you have a very high FICO score (720+, lower for some lenders) you can get a mortgage at 103% LTV, so you can buy a house with no money down and finance the closing costs as well.

    As for the CRAs, they can go jump in a lake. Now I know just how to pull their strings and just what to put in letters, or have my attorney put in letters, to deal with their crap.

    I disputed with Experian and the result was no change to the disputed account. When I asked for a copy of any information the creditor provided Experian told me I need a subpeona! Is this correct?

    Gee, I don't recall there being a subsection in the FCRA stating you are required to provide a subpoena. Maybe Experian needs to take another glance at the FCRA! If you don't raise holly Heck about it no one will.
