Advice handling abusive CA-suit

    This CA has been a thorn in my side for the last few months. They have acted like financial terrorists and would appreciate any advice on the small claims suit I will be filing against them next week.

    To make a long story short, CA went after my husband to pay his father's debt, who lives with us. Both husband and his father share same name except middle. When this account was opened with OC, NO SSN was provided, only opened with passport photo by hubby's father.

    The CA placed this account on hubby's TU report. When I saw this in early April, I contacted CA and said they mistaked the son for the father and was told just to fax DL and SSN to CA and they would delete. Lying dirtballs. Basically, although the CA admitted they were aware this was for the father, they would not delete and continued to try to make hubby pay for his dad's account.


    Eventually I sent an affidavit to both TU and CA, certified mail.....threatening to sue either CA or TU if this account comes back verified.

    Called CA today, and NOW those weasles somehow have the right SSN on the account saying TU has been notified to delete (amazing how for two months they strung me along trying to get hubby to pay for father's account refusing to delete, but now with the threat of lawsuit they delete).

    This CA has taken the liberty of inquiring into hubby's report twice with TU and one with Experian (one in February and twice in late May, I must have pissed the supervisor off in May quesitioning how the CA obtained hubby's SSN because the next day she decided to pull two hard inquiries on hubbys reports and hung the phone up on me everytime I called).


    I am thinking about asking $4000 per FCRA/FDCPA violations. This is $1,000 per inquiry (3) and $1,000 for the placing the CA on hubbby's report and intentionally keeping there until they were served with an affidavit and a threat of civil lawsuit. Plus a few hundered more in damages.

    Any thoughts or advice would be appreciated.

    Dont forget court fees. And fees for obtaining legal counsel.

    This is a classic example of why CRAs should be closed down and scoring outlawed.

    Well I am faxing my offer to settle to their legal department tomorrow....it's on Christine's board.

    It may very well be that they don't respond to the offer. In that case I will file in small claims on Monday, June 24.
