I need some advice on a VOD letter I sent to a CA. I recently moved, and still some of my mail is getting to me a bit late. I received a letter from a CA, with the normal miranda. I sent a VOD letter to them certified return receipt. As of yet I don't think they have signed for it, and my 30 days to dispute with them is up on the 14th. The only address I had for them was a P.O box from there letterhead. Can they hold off on receiving this letter until after the 30 days, so they can get around validating this debt? I have filed a complaint with the better business bureau on the OC disputing this so called debt. Any insight would be greatly appreciated. Thanks
They must provide validation whenever you ask for it - no only within the first 30 days Since you have proof that you requested validation from them you will have a good case if they try anything later on
Your post office stamped certified receipt shows when you sent it. You can check the post office web site and see if they have picked it up yet, whether you get the green card or not. Some CAs never pick up CRRR letters. I believe after 30 days it is returned to you by the post office. Hang on to it if they start claiming you never requested validation, or if they raise the (erroneous) claim that they don't have to validate after 30 days. If you need to re-request validation, either because they claim they never got your request, or because they send you inadequate information, summarize your earlier communications and their dates. Your letters will grow some, but it makes them look bad instead of you if it goes to court and they claim you never disputed. You establish a credible paper trail, and their responses, even if nonsense, acknowledge their receipt.
Thanks for the good advice. I checked the USPS site earlier and the letter has been signed for. I wanted to fight this before they put it on my CR. As of yet they have not. I've never dealt with a CA within the original 30 days, So another question if someone could give me some insight? Since I disputed this within the 30 day period, can they legally put this info on my CR? I've recently filed a complaint with the BBB on the OC. Again thanks for the great advice.
