Drivers must yield the right-of-way to pedestrians who are crossing the roadway within any marked or unmarked crosswalk at an intersection. WORTH REPEATING!!!
And also...we live a 1/2 mile from Kaiser hospital but they took him to a county hospital. They said that Kaiser was not set up for emergency trama. Whatever....now I'm getting medical bills from the county hospital totaling $6k!!!! I called them and they noted that he was a Kaiser patient. They took his Kaiser number and said that they would bill Kaiser. They aslo suggested sending in the bill with a copy of his Kaiser card which I did.

Yeah...well I'm glad I didn't fall for the o-key-doke! I didn't say much of anything on the phone. I didn't want my remarks to be mistaken for admission of guilt of some sort. I'm going to see what the attorney has to say...a nasty letter like Lizard suggested my make all this go away.
Call the police department, and tell them you decided that you want to file charges. They should have the original police report.

MP, I think you should call your state Insurance Dept. and tell them what the SF claims rep is doing. SF is already in big trouble in 4 or 5 states for what they do re claims.
State Farm ripped my mom out of over $10K when I was in a head on collission this summer. The woman who hit me lied and was believed by the cops because she was the right race, older, and from the area. Guess who gets the ticket and the rap? So State Farm told my mom that her $9K car was worth $2K because of miles (a lie!) and they wouldn't pay $3K of my medical bills even though we had a $5K policy. She is stuck with them because of her credit and my accident, no one else will approve her. I wrote nasty letters and they would not budge. They also ripped us off of $1.5K for rental car. The agent, who mind you was supposedly looking out for US as the customers, called me four times a day insulting me as I was depressed, in physical pain, and such. Also, be warned that the other insurance company will look at your reports a lot. It happened to me. Fortunately, they must have decided I had nothing to sue over. The accident was definitely a set up: I think the woman wanted a t-boned accident. It's lucky I didn't die. Anyways, State Farm was HORRID to us from the beginning and that's why I won't go apply for their latest card. Good luck and don't let them jerk you around. Search the web for anti State Farm sites - I found plenty.
You know why they are trying to get you to pay a lump sum now?? Or they are gonna send it to collections immediately?? Think about this, they probably "think" your ignorant and will do whatever they say. In other words they say its your son's fault and then you just pay, because SF said so. Like Bill Collectors they are just trying to cover their a$$ right or wrong (and we all know they're nothing but wrong). From what I understand the client (the butt who hit your son) probably already knows it's his fault so he is leaning hard on his insurance company to collect so that he isn't found at fault. My opinion . Let's be honest. If he really felt he was in the right and your son did something wrong, in this sue happy world, you would have already been contacted by an attorney. I had a friend who hit a car and did not have insurance. State Farm was the insurance company involved. They made payments to fix the man's car. So I think they want a lump sum so that when you do find out their wrong it will be too late because you would have already paid it.
What is your son's ALLOWANCE??? $2.00/week max??? TIMES 25%=$0.50/week..TELL THEM HE WILL PAY AT THE RATE OF $0.50/WEEK...

MP, Sounds like they are simply taking a crack at getting you to pay for the damages without a case nor a chance of getting anything for that matter. 1) Get the police report (if one was made) 2) Tell them to contact you ONLY by mail (keep records) 3) Retain hospital charges and receipts of payment 4) Give your son a great big hug and tell him ALWAYS to look both ways when crossing the street, whether or not the light tells him he can walk!! I just went through a similar he said/she said hit and run thing that even though the police report said this lady was at fault and there were witnesses, since the police officer who wrote the report was NOT a witness it was still tough to get money out of her insurance company to pay off damages. Consult with an attorney if they do not back off but I don't think you need to retain one yet...unless this one you found will work on contingency and you are comfortable with their ability. If they do not back off get yourself a GOOD one, not a yellow page attorney (my opinion only - you sometimes find good ones by accident - but I would not trust it. Especially in this case). Back in driver's ed I'm pretty sure that even a green light means "proceed IF the intersection is clear" The laws are usually set up this way so that drivers can't mow down pedestrians still in the crosswalk after the light changes and get away with it. Same goes for a right turn on red. Driver has to stop first, and proceed with the turn only if the intersection is clear. My little brother got hit walking his bike across the street once. He ended up in the hospital with a concussion after bodily smashing the driver's windshield and rolling off the car. We didn't win in court because it wasn't at a crosswalk. State Farm is definitely bluffing you. You have to owe them money before they can send something to collections, and that means they'd have to get a judgment, first. Likely, StateFarm doesn't want to take you to court because their chances of getting an award when their insuree hit a pedestrian is much slimmer. (In suing you, they'd have the burden of proof that your son didn't have right of way.) Don't send any money to those cheapa$$es. -ingenue
