    Disputed the lates on my Equifax and TU from AES. Came back as verified. I have two options...what are your thoughts?

    Option 1 - Goodwill letter to AES requesting that t hey remove the lates from April 2003 due to the fact that my forbearance was applied retroactively. I have proof that no one at TERI contacted me for 2 months about my appeal despite my attempts to reach someone. I was unemployed at the time and was told that t hey only grant forbearance extensions to people who are working but spent too much money and find themselves in a financial bind.

    Option 2 - Ask for investigation results from TU and Equifax. Ask AES for letter stating my loans were on forbearance from Jan-June 2003 and sending that info to TU and Equifax.

    Thanks in advance.

    AES=PHEAA?

    My problem was slightly different (they processed a letter asking for a forebearance, as a letter requesting a forebearance form because the person I spoke to over the phone didn't tell me one extra sentence to write in the letter (which would seem self-explainatory from the rest of the letter).)

    When I noticed the lates on my CRs, I called and escalated it up as high as I could in the chain of command, and finally got a supervisor who pulled the microfishe of the original letter, and read that it really should have been processed, and sent an update to the three CRAs, the only one which still reported the late comment was TU.

    It turned out that they were removing the lates in the payment history, but TU said that that didn't give them permission to remove the 'xx days late' comment.

    What I eventually had to do was dispute with TU, and call them and let them know that I am not disputing the account, but that TU told me that that would be the only way that they could remove the 'late' comments.

    It now has "In the past 48 months, never late."

    Yes, PHEAA is the same thing. Did you just call the cs line and ask to speak to a supervisor?

    I'm really frustrated dealing with this....grrr.

    Do you think I'd be better off with option 1 or option 2 or should I just try to resolve on the phone first?

    Trying to get a supervisor would probably be the best route.

    Just explain that dispite how they are supposed to be reporting, the CRAs are not reporting it that way, I actually had them send TU about 3 updates MANUALLY, before I gave up and had TU dispute it.

    TU even told me over the phone that the payment history showed was never late, but they claimed that they couldn't remove the late comment. So chances are that it could be a similar 'phantom' comment that AES thinks should be removed based on the updated information, which the CRAs can't remove that way. (Well, it would if we lived in a perfect world where reports were supposed to make sense.)
