AG complaint helped get results

    I've been fighting with a local CA over 3 medical collections. They are from 96. One account I can PROVE was paid in 96 by my insurance company. One other was reaged by the CA and the other not sure of until I receive copies of insurance claims from that year to check. Anyway, in December 2002 I submitted my validation requests to the CA. They totally ignored me. In January I disputed these accounts with the CRA's. CA verified all. 3 accounts x 3 cra's = how many violations? Furthermore CA did not notify CRA's the accounts were in dispute. Is this an additional series of violations? Again in February I disputed with the CRA's and again in February the CA verified the accounts and did not report the accounts as in dispute. How many violations are we up to now?

    It's been 60+ days now and I have been documenting this saga from day one. Last week I sent a letter demanding deletion of the accounts because of failure to validate and continued collection activity. No response. I filed an online complaint with the Ohio Attorney General. Got my letter yesterday telling me they are contacting the CA. Today I faxed an intent to sue letter. 15 minutes later my phone was ringing and guess who?? Some stammering, stuttering idiot from the CA's "legal department" (not an attorney mind you)telling me that all have been deleted and copies of UDF's are in the mail and yada yada yada. I sat and listened as he rambled. He then mentioned the matter has been "cleared up" with the AG. <SEZ WHO?!...LOL> As they are sure the deletion of the account would satisfy the AG. He finally said..."Taking these off your credit report does not absolve you of your debt and do you think you will be making a payment soon?" HELLO! DUH! Did you just make an attempt to collect a still unvalidated debt?! I told him "Sir this conversation is over...Good Bye". He called back but I did not answer. I probably should have let him continue and I sure wish I had a recording of the conversation but I knew if I listened to much more I would lose it. Being at work I did not want the others see me go apeshit over some nitwit on the phone!

    Evidently he thinks deletions absolve him from being sued. As far as I am concerned I AM absolved of these debts until they validate the damn things! NOTHING can absolve that company from breaking the law however.....unless I of course allow it to happen. So I figure...what kind of citizen would I be to allow this to go unpunished?? :)))))))))))))))) I'm filing on Monday.

    Roughly it sounds like upwards of $18,000 in FDCPA/FCRA violations!

    Much depends on what state you live in as far as the effectiveness of an AG complaint is concerned. Sounda like Ohio is a pretty good state, although you do have one of the longest SOL's in the Union.
