Ok, here's the story (sorry for those who think I keep repeating myself) - March 2004 - CC Account closed 90 days overdue - Receive phone call from CA concerning account -Earlier I requested a copy of CR b/c of a denial of credit (no charge offs) - Talked to CA a second time; agreed to a settlement with a post dated check; she was supposed to send an email the next day since it was late; never received it - Realized my rights; stopped payment on check - Sent validation letter to CA certified w/ return receipt - Receive call from CA again; very rude; I explain the fact that I never received anything from her in writing and she claims she has; she even claimed that she has sent 1 or 2 letters to me to my address in the past; also stated that they do not fraudulantly charge accounts and that I was lying; claimed she was trying to help with my credit; even stated that yeah, the FDCPA is important but that THIS IS A VALID DEBT!!! - I hung up on her b/c she was so rude and talking over me - I check my free trial credit report on Experian and now I have a CHARGE OFF!!! - Nothing has been validated, no written info. given to me, has been extremely rude, - Nothing was to occur until the end of this month but she has apparently "made a decision"; she told me in the 1st conversation that I had until March 30 to pay.... WHAT AM I TO DO!!!!!!! The debt is mine but I know nothing of TriAdvantage and they never did their part as far as written confirmation of anything!!!! I don't understand these people...all I asked was written proof that's it.....those are my rights....I feel violated. Did I do something wrong???!?!?!
. Did I do something wrong???!?!?! mimih23 ==================== No but they did. They are trying to railroad you by trampling your rights. After getting the green card back from them i would dispute with the CRAs. 30days after getting the green card back from them i would send the ca the estoppel letter giving the CA 15 days to furnish proper validation and if they don'r the netx letter to them would be An ITS letter with the court date included.
not to sound rude, but you really should try to keep your situation in one thread instead of starting a new one every time something happens. I just responded to your other thread, but now most of that is irrelevant. have you received the green card from your validation letter yet?
