    After the demise of FCNB, this CA, Westmoreland Group has bought all charge-off accounts. Well these bozo's sent me a welcome to Capital One letter requesting a payment for a charge-off that is dated 2/12/1995. They also did an AR on my equifax credit report dated 3/14/2003. Guess what I am doing..

    Well I am sending a demand for non-permissable purpose and a cease and desist on a SOL account. I believe that all people who have had a FCNB account should review their equifax report for an inconspicuous Capital one AR..

    What I am saying is to check your reports for AR from Capital One, especially if you don't have an capital one account.

    I got the same thing, but my FCNB shows positive on my CR and paid off in 6-94, and Westmoreland shows Chargeoff in 6-95!!

    Westmoreland Agency is a subsidiary of Capital One, I had to deal with them regarding an alleged RadioShack account.

    When I was trying to find out an address/phone number for them CapitalOne didn't even know that they had a subsidiary by the name of the Westmoreland Agency. Dispite them being included on the CapitalOne Privacy Notice... ( http://www.capitalone.com/legal/privacy.shtml )

    I wish I had more information handy about them, I think I had to chase down about 10 levels of supervisors at CapitalOne before they found one that could dig up their subsidiaries contact information.

    FCNB was the same way for me. The date they have for charge-off is 2/12/1995. If it shows up, we are off to court and I assure you, I will have damages.

    Either way it goes, it can go off your report, 7 years for reporting of a tradeline. These people are outrageous, we need to get together and sue their behinds off. If it was charged-off then it is charged off. I will go for a total deletion if this shows on my reports. I am of the opinion that the non-permissable purpose pulling of my credit report especially with me being in California is the nail in their coffin. non-p=$2500

    They can buy as many crappy accounts as they want, they are screwing with the with the wrong sista.. I need $2500 for my wedding anyway.

    1-888-794-7097, nail them fast, send them a nice validation,deletion and check your reports for an AR-Capital One.

    I know it is a NO-NO to call a CA, but I'm wondering if I should let them know my FCNB is a positive account, or if they'll find some way to SCREW IT UP!!

    Put it in writing, call them only requesting their address information if they haven't given it to you (or request it from whichever CRA they are showing up on), requesting validation. Don't offer them anything more, until after they respond to the validation request, then you can counter their validation with the information that you have to refute it, requesting that they either re-validate the account with correct information or remove it.

    What about the non-pp for a charge-off account. Can't you get them for that?
