Hi Rotty, don't know if you remember me but I was a regular a few years back... Don't know if the board is still active, Hope to hear from you. Readers Digest Version: In 1999 I got a "fix it" ticket and subsequently moved out of state. After 13 years I forgot about it. I recently applied for a Visa platinum card and was denied. Checked my credit report and there was a collection put on by AllianceOne. I called them to inquire about this as I received no collection notice. They said that the court gave them the assignment on Oct 6, 2011 and they sent the letter to an address I moved away from 2 years ago, so no forwarding. I gave them my current address, which they could have gotten from my credit report, and told them to send me a copy of the letter. I also told them that having not received the original collection letter, I did not have a chance to exercise my rights under the FDCPA and FCRA, and I wanted the collection removed. I was told that all they cold do was list the collection as disputed. Questions: I'm assuming that there is no SOLC for superior court traffic citations. Is there a provision in the law that allows a CA to send a collection letter to any old address, and not getting a dispute, then file a collection and put it on my report? Do I have any recourse or probable action against the CA (legal chapter and verse, please)? It has taken me years to get my credit pristine and now out of the blue this hits and tanks my credit score. I'm not going to bother with the letters to the CA because I think they were lazy, so my next letter to them will be "Intent to Sue" demanding money for each violation. 30 days later they'll get the Summons in the Federal Court District that I now live in, about a thousand miles away from where their office is located. 13 years old? I've never dealt with a traffic citation in collections before, but shouldn't this have dropped off your credit reports by now?
