After of months of fighting with LVNV Funding to remove inacurate and improperly re-aged information off my credit reports, I received a letter from the above noted company that LVNV has placed the account with them for collection - just weeks after clearing my credit file of them. Maybe it was because I was a nice guy, and didn't sue LVNV for re-aging a debt that was already over 7 years old, and just filed a complaint with the FTC naming LVNV, TransUnion and Equifax as violators - (Experian was very good about removal) which finally removed it. I'm not going to ignore this letter - should I just outright threaten them with a lawsuit?? I'm ready - I'm tired of dealing with it... or just tell them nicely to be sure of their information and ask for validation. Although, they were nice about offering 50 cents on the dollar - yeah-- I'll just jump on that and pay it... (ouch - just stuck my tongue through my cheek) Anyone know if they are a sister company of LVNV - wouldn't surprise me, it an old trick. Problem is, most are private companies and difficult to get info on them. I am guessing they are a division of Sherman Aquistions
Go to Bud Hibbs site. He has some documentation of the various names under which Sherman operates. http://www.budhibbs.com/ Since they are collecting under a new name, whether related or not, of course you would dispute and request validation, timely (within 30 days). Did LVNV reage and put an obsolete account on your reports? Is this in fact both past SOL, and past the 7 year reporting period? Is Allied now reporting it?
