Allstate is charging $7.42 month on my Sears card for Accidental Death Insurance. Neither DW or I signed any contract. Nor did we received a policy statement. Nor did my DW or I acknowledge acceptance of the plan over the phone. I called them and they claimed that they have a contract. So, I asked them to send me proof of the alleged contract. Yesterday, they sent a letter addressed to DW stating to call them if there are any problems with the policy. I want to sue them for deducting funds from my Sears account if they can not prove that there is a contract signed by DW or I. What statues are being violated? FCBA? We need assistance fast because no contract means easy lawsuit. Please advise, hreid3 -->Stuck in 500 club-->
LOL! Allstate agents include an accidental death and dismemberment policy in with your auto insurance policy. No doubt, it was included in the papers you signed - look at your contract, it should be in there. Your best bet is to A. dispute the charge with your CC company. B. Dispute the charge with Allstate and advise them that you are disputing the CC charge and filing a complaint with your state's insurance department. C. File a complaint with your state's insurance department - tell them it was not clear to you that you were taking a separate policy for accidental death (it is a separate policy).
My Auto insurance is with State Farm. I never had auto insurance with Allstate. Did you read my post breeze?
Re: Re: Allstate Insurance Theft! Yes, I did. You didn't specify who you had auto insurance with. It doesn't matter. Follow the steps I outlined, and you can take care of this. I assumed you had your auto insurance with Allstate, since I know they do include this with their auto insurance policies, but it doesn't matter that your insurance is with another company. The steps I outlined will get Allstate to back off, credit the charges to your credit card, and most likely apologize. Or you can proceed with asking for the signed contract, with a lawsuit in mind. You still must dispute the charges with your credit card company in writing (FCBA) to make sure all bases are covered. The clincher is to file with your state's insurance department - no company (especially Allstate) wants to be investigated, they will jump and ask how high on the way up when they get notice of your complaint. Do what you please. There was no need to get pi$$y about it. I am an agent, I try to help people with insurance problems. I will make sure I don't respond to your posts in the future.
CHARGE IT BACK DISPUTE THE CHARGE They probably just have the WRONG credit card number for the charges...
