No, I am not meaning statute of limitations. I have a PAID dental collection from Nov â??97. On Wed. 7/16 sent validation letter with the â??CREDITOR DISCLOSURE STATEMENTâ? that was posted on this board, to CA., received green card on Fri 7/18, and on Sat 7/19 received the â??CREDITOR DISCLOSURE STATEMENTâ? completed in full. They also sent a â??copyâ? of the original contract that I signed from the OC and a â??copyâ? of the statement from the OC with work performed and payment from insurance and a $2.00 service charge for a total of $108.00. On the â??CREDITOR DISCLOSURE STATEMENTâ? it also has the payments that I made to the CA. for a total of $110.51. Any ideas on what to try next? Can I charge interest on overpayment by me?? Can I negotiate deletion for overpayment by me?? Am I just grasping at straws?? Any help would be appreciated. Good luck to all. quack
I like the charging interest idea. Make copies of all of their paperwork that shows you overpaid. Compute interest at a rate of (maybe 24%???) whatever you think you should charge. Send them a bill. They'll probably ignore it. Next month, send them a "Past Due Notice." The next month, send them a strongly worded letter about pursuing any and all avenues available (DON'T necessarily say you're going to sue). Somewhere in here, you could offer to settle for deletion of you account. I was actually thinking that they'll ignore you until you get to ITS, then you say you won't file if they'll delete. What do you really have to lose if you've already paid it? Be a thorn in their side and maybe they'll delete just to get you to quit bugging them.
That's the whole point. They don't take it seriously, but they owe you the money. There are people on this board who have had accounts sent to collections for several dollars. That was my point, they wouldn't take it seriously until they got an intent to sue. This could be the actual damages along with any violations they've racked up along the way.

Thanks to all, so far I sent HIPAA letter to OC on 7/24 reveived green card back 7/26. I sent follow-up HIPAA letter to OC on 7/31 reveived green card back 8/2. Re-disputed with TU reveived green card back 8/6. I have not heard from OC or CA. TU sent a letter with names, addresses, etc of all creditors, and a letter "RE: General Policy The federal FCRA requires TU to investigate, free of charge, information on your credit report that you believe is inaccurate. If you have reason to believe that the fee charged by a credit repair company was too high, and/or it services were misrepresented, please let us know if you would like your situation to be referred for investigation by filling out and sending us the form below.With your permission, we will provide the information to the appropriate authorities. It would also be helpful for you to attach any brochures or documents you received from the credit repair company. If you have any additional questions or concerns, please contact TU at blah,blah, blah" Credit repair company?!?!?!? I got my results and a new report from TU 8/18, VERIFIED NO CHANGE. I have not heard from OC, ever, or CA. Do I have any violations, by the CA verifing, under HIPAA? I am just about ready to sue somebody... anybody. I am starting to get a little pi55ed!! Did I waive my HIPAA rights a month ago when I asked the CA for validation even before I knew I had HIPAA rights?? I have not heard anything from the OC.
