I think I have a duplicate entry on my CSC report from American General Finance. Here it is: AGF AGF Charge Off Acct Paid Charge Off Secured Secured Acct # same Acct # same Date Open: 11-95 Date Open: 11-95 DOLA: 2-97 Dola: 2-97 High Credit: 946 High Credit: 946 Terms: 58 Terms: 58 Balance: 946 Balance: 0 Past Due: 946 Past Due: 0 Reported: 9-97 Reported: 7-98 Now are they allowed to list this twice on my report? I have no idea when this was paid off or anything. I was in Japan at the time this was opened so my ex wife must have opened this account. But now just this month I have a new collection account on my CSC report that WASN'T there last month. Credit Solutions, LLC Collection Acct. American General High: 946 Past: 946 Bal: 946 DOLA: 3-97 Now should I validate with the CA and see what they come up with. What about the 2 AGF entries. WHich duplicate would come off if I were to notify through the CRA?
Probably none. With the kind of luck I have had dealing with the CRAs what I disputed would stay there and I would lose about 4 positive tradelines for bothering them. LOL
I would demand that they prove that you opened the account. If you did not open it, you are not responsible.
Bill, How would you suggest I handle this OC in particular? I have read that you can send a validation letter to an OC and then fire off a dispute through the CRA's to lock them in a 30 day window, but there's got to be another option. and tnobles: I thought of that too, but doesn't a spouse have the legal right to open a line of credit? I believe I remember the particulars of this account, if it's the one I'm thinking of. She went to AGF to get financed for a washer/drier. I remember her calling me and telling me she got it but they gave her a hard time because I was the only one with income and I should have been the one to sign for it, but since I was in the military and deployed, they went ahead and let her sign the contract. I believe this is probably what happened. Is that my out right there? Is her signature legally binding since we were married? Anybody know what the particulars are when it comes to this? Oh, sorry about my account info in the above post, It didn't look like that when I typed it up. Makes it hard to read.
I treat them exactly as I would a CA all the way. It's a lot easier if you live in one of the states that makes no distinction between them but if that isn't the case then you have to lock them in through the law of agency. Sometimes you have to refuse to pay to get them there however.
Re: Re: American General diplicate and CA? Bill, Not to sound like the total newb here, as I have been reading and strategizing, but it gets a little crazy once you put the plan into action. How can I find out if my state (Illinois) makes a distinction between, I'm guessing you mean, an OC and a CA?
Re: Re: American General diplicate and CA? It's been posted around here a bunch of times but here it is again. Are you in one of these states? District of Columbia and the following states include creditors in their debt collection laws: Arkansas, California, Colorado, Connecticut, Florida, Iowa, Kansas, Louisiana, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New York, North Carolina, Oregon, Pennsylvania, South Carolina, Texas, Vermont, West Virginia, and Wisconsin. I don't know where that information originally came from but someone posted it here on creditnet a while back and I picked it up and saved it and I've reposted it several times.
Re: Re: American General diplicate and CA? NO! It is fraud. Period. I do not see how she could do it anyway, I have had SEVERAL acoounts with AG, and they always demand a copy of my id, as matter of fact, my hubby has a contract with our AG, he does all their repos, so they know me VERY well, I closed an account with them about 2 months ago and then opened another account about 3 weeks later and they STILL required a copy of my id, even though just 3 weeks prior I closed an account and we have dinner with the manager regularly. My point being, they are very particular about that.
