Americredit Re-aging Problem

    I turned my car in to Americredit in 1998. At the time I could not afford their loan shark 18% interest rate. They sold my account to another creditor and I never hear anything further. The SOL for my state is 6 years and has expired.

    On my August 2005 Equifax report they show the account closed in July 1999. I had an Equifax report from earlier in the year showing March 1998 but destroyed it by mistake.

    I contacted a consumer credit counseling lawyer who suggested I dispute it with Equifax and Americredit which I have done by CMRRR. After 2 months they never responded to me BUT Americredit changed my account closed info from 1999 to 2002 which is incorrect!!!

    The consumer credit lawyer refuses to take my case because I have no records from 1998. They say Amercredit is not obligated to show proof and can keep re-aging the info indefinitely by claiming the previous postings were a 'clerical' error.

    I don't believe this is true but am not sure what step to take next. Does anyone have a suggestion?

    Did you get a second legal opinion?

    Put your paperwork together, with old and new credit reports, copies of letters sent, copies of green cards, and get a second legal opinion on your case.
