AMEX assigned new acct# to old acct

    Can Creditors assign a new account number to a closed charged off account previously reported under a different account number. I managed to get the original AMEX listing deleted from my Credit File. Six months later, the account is placed back on my file under a new account number. Is this legal? Can I sue the CRA for re-inserting a previously deleted account into my credit file without notifying me within the 5 day period? Its obvious that the accounts are the same (all account data is identical except for acct number). Thanks in advance for assistance you can provide.

    I think the fault is with the creditor, not the cra. If a creditor re-reports an acct by changing the acct. #, is that the cra's fault? A lot of times when an acct is deleted, it is cloaked, or permanently deleted. And then the only way for a creditor to get it back on is to change the acct #.

    Amex is now changing their reporting of all accounts. Instead of using your real account number, they're making up "Amex" numbers and reporting those instead. It's to protect your account number.

    Because they're doing this, they're also rereporting old accounts...

    Amex changed all of their account numbers in Feb 2002. If it's been deleted, you simply need to supply the date and report# when it was deleted to the CRA. They are completely aware of this because most of the cloaked accounts have shown back up.

    What do you guys recomend here? My wife got her AMEX account deleted from Equifax. Now it has shown back up under a new account #. Get this the account # is showing up twice with 2 different 'opened dates'. Neither 'open date' is right.

    What to do???

    I called the EQUIFAX "affiliate" and they removed one of two accounts and said they will eventually give all AMEX account holders a scrambled account #...

    You can follow George if you're working with an affiliate or I would write a letter to Robin Holland (search here for email/addy/phone) explaining the situation, give her the date it was deleted (and report number). That office will do a live update immediately and issue a new report... no 30 day wait for an investigation.

    Yeah right. Just got off the phone with TU. Rep claims they have to reinvestigate (30 days) even though she sees that it was deleted previously. She says that creditors change the account number all the time because they can not reinsert with the same account number.

    I got the same response from Equifax, Experian, and Transunion. But, in each case, the rep told me that they had access to the old account number. They all acknowledge that the new AMEX "Acct Nbr" is a re-statement of the old cloaked acct. So, they are liable under the FCRA for re-inserting a cloaked account into my credit file without notifying me of the re-insertion within 5 business days.

    I also disputed each account as having the wrong account number. The FCRA says that any incorrect information can be disputed and must be verified.

    I will file lawsuits against all 3 CRAs in Small Claims court for the FCRA violation if my disputes are not successful.
