AMEX paid CO

    I have a chargeoff (paid) from AMEX showing up on EQ and EX. I have disputed several times, always verified. I asked AMEX to verify the debt, no word from them ever, and they continue to verify.

    At the begining of Dec., I sent AMEX a letter saying basically that I'm gonna sue AMEX, EQ and EX, because someone is screwing up. I sent copies of my prior letter, and noted that they failed to respond and failed to mark account as "in dispute." I asked them to verify if EQ or EX had contacted them regarding the investigation of the account, telling them that I would like to know who is responsible (i.e. who I should sue).

    I have had no response whatsoever, so I appear to have hit a wall with this one. Any advice?

    (I also have a paid Cap1 CO that is sticking as well, but they did verify and so I think I'm stuck there).

    I don't think OCs are required to validate (except maybe in Ca.) - so there is a chance Amex is not doing anything wrong. The CRAs are reporting what Amex is telling them - so I don't think you have anything against them unless they are not verifying with Amex each time you dispute.

    If your goal is to get this tradeline off your reports, start with Amex. Have you tried a goodwill letter since it is a paid charge off?

    I am not an expert by any means, so I will let them chime in - but I don't think you have any grounds to sue anyone...

    Thanks. Yeah, I figured I didn't have any real grounds to sue, I just have been threatening in an attempt to get the tradeline removed. Anybody have any tips at this point? I haven't considered a goodwill for a chargeoff before, because it seems to me that not many would be willing. Perhaps that should be my next step. However, I don't want to admit to anything until I am sure I have hit a dead end.

    Did I do that right? :) newbie has the same problem w/Amex
