Amex recording my conversation

    First, thanks all for this great forum. I just came across this super site and am hoping that it will help me with my new years resl to fix my poor 550 score.
    Anyway, I'm just starting out and ordered my CR'S. After disputing two charge offs. One with Amex and one with CAP1. they came bacj as verified. This happened before I read this forum so natrualy I decided to call Creditor. Since Amex CO is only little money (Another indication that I don't own this account) I called them and offered to pay if they will deleate from CR. As I'm talking with this woman named Ms. Gaspoos, I hear this beeping in the background so I ask her (eventhough I knew) what is this beep in the background? She respondes that this is to "notify" that you are being recorded. So she offered to remove from CR once she recieves payment. BUT listen to this: Th ck has to have MY NAME on it and she told me to wright on the ck a different account # which she refered to as a "Condesed" account. I fulishly followed her instruction but not before writing on the back of the ck that this binds then to delete of CR. Now, so far they hav't cashed the ck. Its been close to two weeks now.

    I wonder if this "condensed account #" along with the requrment that the ck have "my name" on it along with them recording the phone call is just to get as much information AND cashing my ck written out to a different account #

    Any advice will be greatly appriciate

    I am lost. I am not trying to be rude but the title says AMEX recording conversation but then you go on to talk about a tradeline that is not your's that you agreed to pay for deletion? Why would you do that? I am confused.

    Also, it is a given, that you're call is being recorded, I can honestly say, that I have NEVER called a ccc that did not initially tell me (in a recording before a csr picks up) that the call is being recorded.

    I'm sorry, but you really are all over the place with this. Please repost using the expanded, long, detailed version. Oh, and how is the fact that the Amex charge off isn't for a lot of money, further proof that it isn't yours?

    I state in my post how I was being recorded while talking to Amex.

    The fact that we are talking about less then $200 charge off should in my opinion indicate that it is inaccurate, Since I have paid as agreed charges of thousands.

    does anybody have any idea about the condensed acc # and about the fact that they havn't cashed my ck yet?

    But I still wonder why if the chargeoff is not yours, would you offer to pay it?

    Let's be real.

    Not everyone ascribes to the philosophy that if it aint yours don't pay it.

    I myself have paid a small $200 ALLEGED debt just to make it go away.

    I knew that the time it takes me to argue my point is worth a lot more to me than a lousy 200 bux. Not to mention the potential for hassle once an account is posted.

    Perhaps Fellow made a simple business decision and just paid off it's neusance value. Not necessarily the wrong choice in all cases.

    All that said; I also don't see why it's small size indicates that it's not his.

    LOL

    Oh - and I already know there are many who disagree. And BTW, if it's any more than 200 bux I probably wouldn't.

    Rule 1
    Phone agreements mean nothing as you would need to go to court in the end to prove the conversation.
    Rule 2.
    Write YOUR agreement and send CRRR and upon reciept of signed copy ,you will mail payment in certified funds etc
    Rule 3
    Make sure it states clearly what you are paying and you are paying under duress and you are not admitting any liability or ownership of said accounts and that the CO will remove all references to ALL acounts bearing your name with ALL CRA's
    If you have good tradelines list them as exceptions
    Failure to so within a stipulated time frame will render the agreement void and will make Amex liable for all legal and court costs to remedy this action plus and agreed settlement of 5 times the amount offered.

    This will scare the crap out of the clerk and he / she will refer it to legal once legal see that it's a screwup they may drop the whole deal ..


    In New York State Insurance companies used to put agreements on the back of claims check and people (thought) they signed their rights away. The ins co's soon found out that this would not hold up in court as any signature of would need to have full disclosure which you could never fit on the back of a check. Unless it as about 8 pages long..
    So using the back of the check trick IMHO is meaningless. From a contract perspective you have no witness and you have no agreed result so it could bounce back and burn you ..
    As you really don't know WHAT YOU ARE PAYING. That amount may only be interest and there is another account for $10K that you do not know about..



    FYI I am not a legal beagle and I don't play one on credit net. But there are some settlement docs posted so you can grab the language from there..

    If you have other open acoounts maybe they are looking for your checking info to garnish it ..
    I tell everyone when paying to use Post Office money orders and send by CRRR mail .
    This way if they don;t live up to their agreements you can threaten them with mail fraud.
    As they offered a product which you agreed to and then defaulted on the offer. All done by mail.

    Again, as mentioned I offered to pay before I found this site. I thought my options are to either pay credit repair company $700-$900 just to sign up , or simply pay to get them off my back. Especialy since ther are a few late payments that I will need to dispute on my CR and I don't want to get flagged at CB.

    I thought it'l be easier and quicker AND cheaper to do it this way.
