Another BK 13 Question

    Some of you may have read the other thread I had going on this. I have another question about bankruptcy.

    There is a married couple invloved in a chapter 13, this is their second time filing because a creditor objected to the first one and it was dismissed. It was dismissed because of something to do with one of them, not the other.

    The new bk 13 was filed with only one of them, this was done to save their home from foreclosure.

    The bk payments that were agreed to are way out of line for what they live on. Their attorney will not retun phone calls and I am doing what I can with some other organizations to try and help them.

    Too make a long story short, we are trying to save their home. New Century will not work with them and they can not afford the bk payments.

    Since the primary person on the home loan is not in chapter 13, does that mean that he can apply for a refinance on the home? I know that the trustee has to approve a refinance, but if her name is not on a refinance can't they just apply somewhere and if he was approved they could dismiss the chapter 13?

    Does any of that make sense? We are on a very short timetable here and are really needing some help.

    They can afford to make the old mortage payment of $650 now, but New Century will not work with them.

    The home is appraised at 100k and they owe about 66k.

    That "Attorney will not work with them" is strange.
    My guy got paid monthly throughout the term of my repayment. iS HE never returning CALLS?

    Are you all explaining the situation to the atty?
