Another MRC Receivables victim (please help!)

    I just received a notice from a court in Franklin County, Ohio. It states that MRC Receivables is going to place a garnishment on my wages from my employer, Walmart, in five business days if I do not request a hearing to dispute this. I have done a bit of research on MRC Receivables and read stories fron the forum, and I can say that I am shocked at what people have been put through. How can MRC Receivables get away with these sort of practices? From what I understand, my credit reports were probably examined and I was chosen because I have past accounts that are in default. MRC Receivables, "acting on the behalf of [fill-in-the-blank]", went through the courts, and now the courts are about to garnish my wages.. which will be funnelled to MRC Receivables? I have read that folks here have asked for a "DV" or "debt validation" as a means to verify the so-called information. MRC Receivables is coming after me for $5580.64, but nowhere within the paperwork from them, or the Frankin County courts is any mention of who the account is with or anything else. This makes the whole thing seem very fishy. This is day 1, and with what little I have read about MRC Receivables and from folks here in the forum, there is a chance that they may succeed in garnishing the requested 25% of my wages to satisfy this "debt". What do you suggest? I thought about contacting them to inquire and validate the information. Franklin County court has a case number, although I don't know what I can do with it from where I live now (Tennessee). I have four days remaining and I am not about to give up without a fight. What MRC Receivables is doing is wrong and hurts folks financially, not to mention the emotional upset. I hope to hear from folks here as I prepare for this fight. I am going to keep a journal and perhaps even blog about this experience in hopes of offering help for others against MRC Receivables.

    Wow - is there an attorney in your area that can help you? There's not alotta time, and he might can get this stopped, or find an angle for you to do something to 'fix' this.

    Some people are scared of collection agencies, and that's why most of these creeps get money and judgements, cause people are too scared to fight.

    I hope someone who's been through this can answer.....and ya, I've heard about this company, and they are as bad as they pretend they are :)

    It is now the morning of day 2. I went to AnnualCreditReport.com before I went to bed and was able to pull a credit report from Equifax. Sure enough, MRC Receivables has entered a "judgement" against me. With me working 10a-7p these past couple of days, it is difficult to make any phonecalls. However, I will be off tomorrow and the following day. I will use that time to continue my efforts to fight this. I believe that I now have at least the minimal amount of information that I need. I still do not know what, exactly, MCR Receivables is attempting to collect for. Perhaps a phonecall is in order? Again, any suggestions will be appreciated. I really want to put these folks in thier proper place.

    It sounds like they got a default judgement. Did they serve you with a summons first? If not, then you can hire an attorney, and get the judgement vacated for lack of service. You may then have to fight them in court.

    If you don't know what the judgement is for, they may have been attempting to collect someone else's debt from you, or even a debt you have already paid or settled, and if you let them, they will succeed.

    Day 3.

    No, I never received a summons.

    I feel I need to bring everyone up to date as I have learned some information through my personel department. ADP has a department that handles garnishments. They have contacted my employer and setup the garnishment. When I called ADP, a rep told me that a law firm, Javitch, Block & Rathbone L.L.P., had initated this process. So how is it the MRC Receivables is listed in my credit report, and not this law firm? Should I contact the law firm, MRC Receivables, the clerk of the court, or all of them? And how is it that I already have the garnishement instated when the paperwork clearly states that I have five business days to dispute this? A chain seems to be forming, with me on one side, links consisting of various agencies in the middle, and MRC Receivables on the other side. Could the attorney have picked up the account in question, or have been contacted by MRC Receivables? Is there a connection here, and if so, what is it and why?

    You need to get a good attorney, immediately.

    From what you have said, it appears that:
    1) You were not properly served.
    2) The venue may not even have been correct
    3) You don't know who the original creditor is, what the original debt is, if it is yours, or if the amount is correct.
    4) They are already taking your money.

    (1), (2), and (3) may all indicate they were actually collecting on someone else's debt that you didn't owe. The judgement may, or may not, even be against you, but they are set up to take your money. The garnishment may even affect your job and career.

    There may be a variety of reasons to get the judgement vacated, stop the garnishment, and get your funds returned, but only if you act promptly. Contacting any of the parties involved by phone will not accomplish anything. You need an attorney, before they impoverish you to the point you cannot afford one.
