I have seen a few posts about inquiries and now I am a bit confused. The question is : I have two collection agencies that have pulled a number of inquiries. I have seen a few posts that state no one can pull credit inquiries with permission. I have seen a few posts that says if you owe money the ca can pull an inquiry. Also I have read if the account has expired for reporting, over 7 years, then an inquiry cannot be done. Which is correct?
I'm sure you mean without permission LOL. The part of the FCRA that allows CA's to pull without consent is says: (3) To a person which it has reason to believe (A) intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer; or So yes if you owe a CA money, they can pull. Even though the 7 years may be up, they can continue to attempt to collect from you, until you raise the affirmative defense that the debt is out of SOL. (if it is in your state)
