Another question on very large debt popping up on credit

    I pulled my credit this morning as a result of getting a strange call last night from DC with debt from 2000! It shows a large debt of 3,880 dollars at R. Curtis and Associates (a collection agency) with no dates or anything. I have received nothing, and it does not ring a bell for anything!
    What are my rights as far as credit reporting on this? And what should my first and most effective move be to resolve??

    First move would be to send a DV LTR to this CA. Be sure to include that your pulling of your credit report on date x was the first time you were made aware this account existed. Always refer to the debt as alleged debt, in your letter. The SOL in Florida is 5 years, they can't come after you for it, and negative info needs to be removed from your report after 7 years from when it'c charged off. Unless you made a payment on this account some time in 2006 or later, they can't report this.

    There is no Date of first delinquency listed? This is required to be there. Or Date opened? Do you know who the OC is? Have any paperwork on that (meaning statements/etc) that may show when the account closed.

    Two new pieces of info: 1. I called number on my CR and DC told me it turned out to be a debt from a med bill of my mom's (she passed from cancer at the time). I already had sent the paperwork showing I wasn't liable in 2007, and the DC told me he saw that I had sent everything in and they deleted the account. He said the OC (Colonial Healthcare) actually changed my name to a slightly different spelling and submitted it again but they didn't pick up on it. He apologized profusely (shocker), and told me they were deleting the entry with the CB and sending me a confirmation of all of it. Crazy!
    2. Regarding Date of first delinquency; Date opened, I do have one debt listed on my CR from Bank of America without any of this info, but after dealing with a bunch of shady stuff with Cavalry Portfolio Services (If that's still their name!) I turned to OC (BofA) and actually got the correct info mailed to me. Calvary had told me 2008 and lied about some other stuff to get a pmt out of me. Last pmt. was actually 2006,and was charge/off 2007. I saw an attorney and they never responded ever. Yesterday I got a call about this out of the blue! What is going on? Why all of a sudden these DC calling me? Is it because I pulled my CR? iT'S SCARY

    Hi lcook - I'm not sure why these sudden calls out of the blue - it might be because your info has been updated, but it's hard to say.

    For the B of A debt, if you now have the DOFD (the date that matters most in removing an old debt) you should then find out your state's SOL? 2007 could fall within that time depending on where you are. If so, you can write another letter to the CA regarding the SOL and demanding its expiration. Here's an example: Debts Passed SOL Letter
