Ok, I see all sorts of posts about medical collections (paid or unpaid) and HIPAA, and how easy it is to get these TLs removed, BUT... what if you have on your reports a paid medical bill that never went to a CA? How do i get it removed? I can't threaten w HIPAA because there was never a CA involved. This is from an MRI place that never received payment from the insurance co because they were sending it to the wrong address. It finally got straightened out, and the MRI place got their money, but not before they listed it on my dad's CR. It is reporting correctly (as 'paid') but he wants it removed, and I'm just not sure what to tell him. Should I go the 'OC validation' route? thanks!
i think i may have found something on my own for a change, lol... what do you guys think of this... from HIPAA: "The Privacy Rule prohibits a covered entity from using or disclosing an individual's protected health information ("PHI") unless specifically authorized by the individual or otherwise allowed under the Privacy Rule. In general, PHI encompasses substantially all "individually identifiable health information" that is transmitted or maintained in any medium. "Individually identifiable health information" includes health information that is created or received by a health care provider, health plan, employer, or health care clearinghouse, and that relates to an individual's physical or mental health or condition, including information related to an individual's care or the payment for such care. In addition, the information must identify the individual or there must be a reasonable basis to believe that the information could be used to identify the individual." OK, that almost says that my dad has a legitimate reason for a tradeline that says "MRIs 'R Us" to be removed. If a health insurance company or potential employer sees that, it could be used against him, wouldnt one think? (ok, i'm really reaching I know) But, could i at least use this as fodder for a letter? or should i go the nutcase route? please help. thanks.
Does his insurer have a contract with the provider . This is a providers screw up not the patients so it should not have been reported in the first place.
thanks lb. thats what I thought. Should he just go with something that says 'please remove this, it should never have been there, you may be violating HIPAA'...etc...? in other words, should he send a nice, goodwill-ish letter or a use stronger approach? thanks.

I'm not a HIPPA expert but, I believe if the account is either "paid" in full or "settled" and no balance owed, they are not allowed to list it on your credit report. I'll stand corrected if I'm wrong.
Ok, I've read and re-read as much as i can right now. I havent found a thing that pertains to this. WhyChat? are you around? do you have anything relating to Hipaa i could use for an OC who didn't use a CA? I called my Dad and he says there is no reference to a CA on this. It is paid, and reporting as paid, but I want to help him get it deleted. I'm going to work on a letter and I'll post it here when I'm finished. anyone with any ideas on what to put in the letter please post. thanks.
