According to Section 614: When and investigative report aka background report is done on a employment candidate, NO PUBLIC RECORDS may be reported UNLESS they were verified with the past three months. I am sure they don't comply with this one either.
Love, that provision is very confusing and easily misunderstood. The very beginning of the FCRA makes a distinction between a "investigative credit report" and other credit reports. An "investigative" report is when they send somebody out to your house or to the courthouse on foot to dig up the dope about you. In the good old days, this was a common way for the old credit bureaus to collect info about consumers up until about 30 years ago (especially the infamous "Retail Credit Company" -- later renamed Equifax when they wanted to redo their old terrible intrusive image in 1975). It's very unlikely that there are any "investigative" reports in any of your credit files anymore. Rather, judgments and liens are now actually placed on your reports by the courts themselves (which usually transmit the data electronically to the CRA databases, although there are some manual reports sent regularly by small courts usually in rural areas). In other words, the CRAs aren't required to verify such reports within three months UNLESS the CRA initiates the detective work like they used to do years and years ago. For regular credit file insertions initiated by courts, no verification is needed since the court put it there in the first place. I hope this helps (rather than confusing matters further, lol). Doc
Ueah, I checked this out thoroughyl after some discussion in chat (I was having a background check done at the time). Their only requirement wrt public records, is to report the current status. I passed the background check, btw. It is so nice to know Wherever I may go "They" will smile When they see my credit file. tee hee.
